These Terms & Conditions govern the relationship between you (“Client”) and Tytana Luxe Safaris (“Company”).

Tytana Luxe Safaris Limited

Effective Date: 01 February 2026

  1. Introduction

Your contract in respect of your holiday is made with Tytana Luxe Safaris Limited (“the Company”), registered in Kenya. All bookings are subject to these Terms & Conditions. By booking with us, you confirm that you have read, understood, and agreed to these terms.

  1. Communication

All official communication will be conducted via:

  • Email: info@tytanaluxesafaris.com
  • Or other authorized Company channels
  1. Booking & Contract
  • All bookings must be made through an authorized Company representative.
  • A completed booking form and deposit are required.
  • Receipt of a deposit does not guarantee confirmation.
  • A booking is only confirmed upon issuance of a Confirmation Invoice and relevant service confirmations.
  • The Company reserves the right to refuse any booking and will refund any deposit received in such cases.
  • The person making the booking accepts responsibility for all participants.
  1. Payment Terms
  • A deposit is required to secure a booking (as advised at the time of booking).
  • Full payment must be made at least 15 days before departure.
  • Bookings made within 15 days require full payment upfront.
  • Failure to pay on time may result in cancellation and forfeiture of deposit.
  • No payment reminders are guaranteed.
  1. Pricing & Surcharges
  • The Company is not obligated to provide a cost breakdown.
  • Prices may change prior to confirmation.
  • After confirmation, surcharges may apply due to:
    • fuel or transport costs
    • exchange rate fluctuations
    • government taxes and levies
  • The Company will absorb up to 2% of any increase.
  • If the increase exceeds 10%, you may cancel within 14 days for a refund (excluding costs already incurred).
  • Full payment within 7 days of confirmation may secure a fixed price.
  1. Special Requests
  • All special requests (e.g., dietary needs) must be indicated at the time of booking.
  • While we aim to meet requests, they are not guaranteed unless confirmed in writing.
  1. Changes & Amendments

By the Company

  • The Company reserves the right to modify itineraries due to operational, safety, or environmental reasons.
  • Minor changes (e.g., timings, similar accommodation) do not warrant compensation.

Major Changes

Major changes include:

  • Trip cancellation
  • Delays exceeding 12 hours
  • Change to inferior accommodation

In such cases, you may:

  1. Accept the change
  2. Choose an alternative package
  3. Cancel and receive a refund (excluding unrecoverable costs)
  1. Cancellations & Refunds

All cancellations must be submitted in writing.

The following charges apply based on the total booking cost:

  • 30 days or more before departure: Loss of deposit
  • 15 – 29 days before departure: 50% of total booking cost
  • 8 – 14 days before departure: 80% of total booking cost
  • 0 – 7 days before departure or no-show: 100% of total booking cost

Additional Conditions

  • Deposits are non-refundable
  • Christmas & New Year period (20 Dec – 05 Jan): 100% non-refundable
  • No refunds for unused services after trip commencement
  • Refunds (if applicable) are processed within 14–30 business days
  • Third-party costs (flights, park fees, hotels) may be non-refundable
  • Cancellations submitted on Sundays will be processed on the next working day
  1. Force Majeure

The Company shall not be liable for failure to perform due to events beyond its control, including but not limited to:

  • natural disasters
  • pandemics
  • war or terrorism
  • political unrest
  • government restrictions
  • airline disruptions
  • adverse weather

No compensation shall be payable in such circumstances.

  1. Company Right to Cancel

The Company reserves the right to cancel any booking before departure. In such cases, a full refund will be issued, but no additional compensation will be provided,

11. Client Responsibilities

Clients are responsible for:

  • valid passports and visas
  • vaccinations and health requirements
  • travel documentation
  • compliance with local laws
  • timely arrival for all departures

Failure to comply may result in denied travel without refund.

  1. Travel Insurance (Mandatory)

All clients are required to obtain comprehensive travel insurance covering:

  • medical emergencies
  • trip cancellation or interruption
  • personal liability
  • loss of personal belongings

The Company is not liable for uninsured losses.

  1. Limitation of Liability

The Company acts as an intermediary between clients and third-party service providers (hotels, airlines, transport providers, etc.).

The Company shall not be liable for:

  • personal injury or death
  • loss or damage of property
  • delays or disruptions beyond its control

Any liability, where applicable, is limited to the total amount paid for the booking.

  1. Assumption of Risk

The Client acknowledges that safari travel involves inherent risks, including:

  • wildlife encounters
  • remote locations
  • limited medical facilities

By booking, the Client accepts these risks.

  1. Indemnity

The Client agrees to indemnify and hold harmless Tytana Luxe Safaris from any claims, damages, or expenses arising from their actions, negligence, or breach of these Terms.

  1. Data Protection

The Company processes personal data in accordance with applicable data protection laws, including:

  • GDPR
  • Kenya Data Protection Act, 2019

  1. Website Use & Intellectual Property

All website content, including text, images, branding, and materials, is the property of Tytana Luxe Safaris and may not be copied, reproduced, or used without prior written consent.

  1. Complaints
  • Any issues must be reported immediately during the trip to allow resolution.
  • Formal complaints must be submitted within 7 days after travel.
  1. Refusal of Service

The Company reserves the right to refuse or remove any client whose behavior may endanger the safety, health, or enjoyment of others. Refunds will be limited to unused services, less applicable fees.

  1. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya.

Any disputes shall:

  1. First be resolved amicably
  2. If unresolved, be referred to arbitration in Kenya
  1. Amendments

The Company reserves the right to update these Terms at any time. Updates will be published on the website.

  1. Acceptance

By booking with Tytana Luxe Safaris, you confirm acceptance of these Terms & Conditions.
