Terms & Condition

All bookings must be made through an authorized representative of Tytana Luxe Safaris.

Your contract in respect of your holiday is made with Tytana Luxe Safaris Limited (the Company), and all bookings are subject to these terms and conditions.

1. Contract & Communication

a) Your contract in respect of your holiday is made with Tytana Luxe Safaris (‘the Company‘), registered in Kenya, and all bookings are subject to these terms and conditions.

b) All communications by the Company in relation to your holiday will be sent through the official company email addresses ([email protected]) or other authorized channels.

2. Booking & Payment

c) All bookings must be made through an authorized representative of the Company. At the time of booking, the Company’s booking form must be completed and submitted together with a deposit as stipulated by the authorized representative. Cut-off dates for deposits will be communicated accordingly.

d) Receipt of the deposit and booking form by the Company does not guarantee nor imply confirmation of the booking. No booking shall be confirmed until the Company issues an official notice and hotel confirmation number. The Company reserves the right to refuse a booking without giving any reason and shall in that event return any deposit received.

e) Full payment for your holiday must be made at least 15 days before the departure date. If payment is not received by the due date, the Company reserves the right to cancel the booking and retain the deposit. The individual or entity who signs the booking form guarantees payment of the total amount in accordance with these conditions. It is the responsibility of the signatory to ensure the Company receives full payment by the due date. No payment reminders will be sent.

f) If you book within 15 days of your departure date, full payment must be made at the time of booking.

3. Special Requests & Service Guarantee

g) All special requests, such as dietary requirements, should be noted on the booking form at the time of reservation.

h) The Company will provide services as outlined and confirmed in writing.

4. Pricing & Surcharge

i) The Company is under no obligation to furnish a breakdown of the costs involved in a holiday.

j) The Company reserves the right to notify you of any price increase before accepting your booking.

k) After a Confirmation Invoice has been issued, the holiday price may be subject to surcharges under limited circumstances, including fluctuations in transportation costs, airfare increases, government taxes, and exchange rates. The Company will absorb 2% of any increase before passing on any additional cost to the client.

l) If a surcharge increases the total holiday price by 10% or more, you may cancel your booking within 14 days of the revised invoice and receive a refund, excluding costs already incurred.

m) If you choose to pay for your holiday in full at the time of booking, your price will be fixed at the quoted cost, provided full payment is received within 7 days of the Confirmation Invoice date.

1. Contract & Communication

n) Occasionally, it may be necessary to make changes to your holiday. The Company reserves the right to do so at any time and will notify you at the earliest opportunity.
o) If a major change to your tour is necessary (not due to circumstances beyond the Company’s control), you may:

    • (i) Accept the change,
    • (ii) Purchase another holiday from us, or
    • (iii) Cancel your holiday.

p) No compensation will be payable for minor changes, such as small adjustments to departure/arrival times, changes in aircraft type, or substitutions of accommodations with comparable or superior standards.
q) Major changes include trip cancellation, airport changes, delays exceeding 12 hours, and accommodation changes to an inferior standard.
r) Compensation will not be paid for changes or cancellations caused by Force Majeure, including but not limited to natural disasters, war, political unrest, terrorist activity, airline strikes, airport closures, adverse weather, or any other event beyond the Company’s control. It is essential to obtain adequate travel insurance.
s) The Company reserves the right to cancel your holiday before departure, even after confirmation. If this occurs, a full refund will be issued, but no additional compensation will be provided.
t) If you fail to pay the balance of your holiday at least 30 days before departure, the Company will cancel your booking and apply the cancellation charges below:

Cancellation Fees:

30 days or more: 50% of the deposit
15 – 30 days: 100% of the deposit
8 – 15 days: 80% of the tour cost
1 – 7 days: 100% of the tour cost

u) The Company reserves the right to refuse any person as a tour participant if their behavior could endanger the health, safety, or enjoyment of others. In such cases, refunds will be limited to unused services minus administrative fees.

Note: Written cancellation will accept on all working days, except Sunday, Any cancellation sent on Sundays will be considered on the next working day (Monday).
For the X-mas and new year period from 20 Dec to 05 Jan the payment is non-refundable.
In case you cancel the trip after commencement, refund would be restricted to a limited amount only which too would depend on the amount that we would be able to recover from the hoteliers/ contractors we patronize. For unused hotel accommodation, chartered transportation & missed meals, etc. we do not bear any responsibility to refund.
